India wants Italy to honour its sovereign guarantee - Economic Times

NEW DELHI: The long-standing diplomatic row over the trial of two Italian marines, accused of killing two Indian fishermen, deepened on Tuesday after India said Italy must honour its sovereign guarantee that the marines would return to face trial here.

The government was left to firefight on multiple fronts following Rome's sudden challenge as anger spilled out onto the streets in Thiruvananthapuram and the opposition charged that the government was responsible for the unseemly turn of events. The issue disrupted Parliament on Tuesday morning, when the Bharatiya Janata Party accused the government of helping the marines to walk free.

"This is betrayal and bluff by the Italian government. It is a breach of trust between two sovereign nations and the act is completely unacceptable... We have witnessed the same in the Ottavio Quattrochi case and now a similar action where Italian government has virtually challenged India's highest court," BJP spokesperson Rajiv Pratap Rudy said.

In Thiruvananthapuram, a fishermen association burned the effigies of PM and the two marines Massimiliano Latorre and Salvatore Girone.

Late on Monday evening, in a decision seen as a diplomatic slight, Italy conveyed to India that "since a controversy between the two states has been established, the two Italian marines, Mr Latorre and Mr Girone, will not return to India..." Italy has all along maintained that India did not have the jurisdiction to try the marines.

On February 18, the Supreme Court had directed the Indian government to set up a special court for trial in the matter. The court held that while the Kerala government had no jurisdiction in the matter, the Centre did.

Italy now says that since the Indian government did not respond to its request to seek a resolution through bilatera l dialogue, it recognises a bilateral dispute and India must now initiate a resolution through arbitration or through consultations envisaged under the United Nations Convention on the Law of the Sea. India has summarily rejected this stand.
