The Supreme Court on Friday granted bail to RJD chief Lalu Prasad, who is serving a five-year term in Ranchi's Birsa Manda jail for his role in the fodder scam.
Supreme Court has asked the trial court, which heard the fodder scam case, to set conditions for his bail.
Lalu's membership as the Lok Sabha MP was scrapped after he was sentenced to jail. In an affidavit, filed on Thursday, CBI contested Lalu's contention that he was entitled to bail as the other 25 co-accused who were given bail by the HC.
The agency said those released have already completed half of their sentence period in custody, which was not he case with Lalu. CBI said he has spent a little more than one year in jail, 10 months as an undertrial and over two months after his conviction on September 30 this year.
Lalu is also facing trial in other four cases related to fodder scam, which are now in advanced stage of trial, CBI said. One of the cases is at the stage of recording Lalu's statement. It also said that Lalu was part of the criminal conspiracy and had knowledge about the fraudulent withdrawals. He had granted extension of service to the co-conspirators.
In his bail plea Lalu has said: "No reason has been given by the hon'ble high court for the rejection of the petioner's prayer for bail. The petitioner has been treated differently in the matter of grant of bail in as much as some of the co-accused as stated above who are similarly situated has been granted bail."
It further added: "That the petitioner was the chief minister of the State of Bihar, the union railway minister is also the leader of a political party in the country and until the date of his conviction in the present case was a sitting Member of Parliament hence. He is not likely to abscond from the country."
