| The CBI investigator in Aarushi- Hemraj double murder case wanted to arrest Nupur Talwar on the basis of material gathered during the probe but was not permitted by senior officers, a special court here was informed on Wednesday. CBI Additional SP AGL Kaul, who led the second probe team in the sensational double murder, was asked by the defence counsel to explain why Aarushi's mother Nupur was not arrested if there was enough evidence against her. "I wanted to arrest Nupur Talwar on the basis of material gathered during the investigation and question her. But my senior officer Neelabh Kishore did not permit me so I did not arrest her," Kaul said during the cross examination. He said it was correct to say that Nupur Talwar was not included in the accused column of the closure report submitted by the agency but it is clearly mentioned in the report that Rajesh and Nupur were in connivance in the crime. With Wednesday's proceedings, Kaul's deposition before the special court here has been completed. He was the last prosecution witness to be produced before the court, CBI counsel RK Saini said in Ghaziabad. During his deposition, Kaul said the accused did not co-operate with him during the probe and attempted to misguide him. Kaul said Talwars wanted CBI to carry out LCN DNA test on the evidence seized by the agency but it was not done because Centre for DNA Fingerprinting and Diagnostics and Centre for Cellular and Molecular Biology have opined that since DNA testing of these samples had already been done, the test asked by Talwars cannot be conducted on them. The officer said Rajesh Talwar had referred the name of a foreign expert who could have carried out these tests. "I contacted the expert and four-five other experts also. Only that expert who was named by Rajesh agreed to conduct the said test. All other experts refused to conduct the test. I checked about this expert from Interpol which said he does not have a certified lab. I also found that he was in touch with Rajesh Talwar earlier also," Kaul said. The officer told the court that the test sought by Talwars could not be carried out in India because it was not a recognised test in Ghaziabad. "I do not known whether LCN DNA test can be carried out even after years have passed. I have included the record of discussions with experts abroad in my case diary but did not attach in the closure report," kaul said. He said it was wrong to say that he was lying on the subject or has given a wrong statement. Kaul also negated the theory that murder could have been committed by friends of Hemraj--Krishna, Rajkumar and Vijay Mandal — and that they entered the flat. "It is wrong to say that evidence collected on May 16, 2008 indicated direct involvement of Hemraj's friends who could have entered the flat and carried out the murders. It is also wrong to say that head injuries of Hemraj were inflicted by Krishna, Rajkumar and Vijay Mandal on roof," he said. Kaul asserted that it was wrong to say that he did not bring to fore the evidence which established the role of the domestic servants in the crime and tried to faslely implicate the accused — Rajesh and Nupur Talwar — in the crime. "It is also wrong to say that they (Rajesh and Nupur) did not have any hand in the murders and were not hiding any evidence with regards to the case," he said. Kaul had on Tuesday told the special court that according to investigations, Rajesh Talwar had found his daughter and domestic servant in "objectionable position" and killed them using his golf stick and a sharp-edged weapon. Fourteen-year-old Aarushi was found dead with her throat slit in her bedroom on May 16, 2008. The initial suspicion went on Hemraj whose body was later found in the their terrace at Jalvayu Vihar in Noida on the outskirts of Delhi.
