I wanted to arrest Nupur Talwar, but my senior did not give permission, CBI ... - Indian Express

Deposing before a Ghaziabad court, where Rajesh and Nupur Talwar are being tried for the murder of their teenaged daughter Aarushi and domestic help Hemraj, CBI investigating officer A G L Kaul on Wednesday said he wanted to arrest Nupur but did not get the permission from his senior.

Kaul's statement comes two days after he had told the court that he wanted to file a chargesheet against Rajesh but his senior in the CBI believed that there was insufficient evidence and asked him to file a closure report.

A special CBI court, however, rejected the closure report in February 2011, and made Rajesh and Nupur the main accused in the 2008 murders.

On Wednesday, Kaul told the court of Additional Sessions Judge Shyam Lal, "Based on the available material during investigations, I wanted to arrest Nupur Talwar and question her, but my senior officer Neelabh Kishore did not give me permission to do so, which is why I didn't do it. It is true that Nupur Talwar's name is not mentioned in the column listing the accused, but the report says very clearly that the crime was committed by both the accused(Rajesh and Nupur Talwar) together."

Kaul also explained why an LCN (Lowest Common Number) DNA test was not carried out on evidence taken from the crime scene.

"The accused had sent me an e-mail, in which they asked for an LCN DNA test on the samples from the crime scene, but this was not done because when I enquired about this from CDFD Hyderabad, and CCNB Hyderabad, they said it could not happen because a DNA test had already taken place. Dr Rajesh Talwar had spoken about a foreign-based scientist who said the test could be conducted, so I spoke to the scientist and (also) 4-5 other foreign scientists. Only the scientist Rajesh Talwar referred me to agreed to conduct the test, while the other scientists I spoke to refused. When I enquired about this scientist from Interpol, it was found that he did not have a registered laboratory. I also found that this scientist was in contact with Rajesh Talwar from before. LCN DNA tests are not conducted in India because they are not recognised," Kaul said.
