Italian marines not to be hanged - Deccan Chronicle

New Delhi: The Union government has said that there is no question of the death penalty being imposed on the two Italian marines charged with the killing of two Indian fishermen even if the Supreme Court was to return a guilty verdict.

Official sources on Saturday contended that the latest Supreme Court order in the marines case which had come on Friday, has been 'read out of context'.

The sources said that as per the SC order, the January 18 judgement 'remains in operation' and that the NIA (National Investigation Agency) has been designated to pursue the probe in the Italian marines case as per the January 18 SC order and rather than the NIA Act .

In its April 25 order, the SC had allowed the NIA to probe the case against the marines, Massimiliano Latorrre and Salvatore Girone. The Italian government had wanted the probe shifted to the CBI while contending that the charges against the marines were not covered by the NIA Act.

Further, official sources said FIR No 2 dated August 29, 2012 will be the basis for the investigation. Therefore, it follows that the later FIR re-registered by the NIA under the NIA Act is redundant and for the present the Suppression of Unlawful Acts Against Safety of Maritime Navigation Act 2002 has not been invoked.

The Italian government's lawyer, senior advocate Mukul Rohatgi had contended before the SC on friday that the NIA could probe the case only if charges under the Suppression of Unlawful Acts Against Safety of Maritime navigation and Fixed Platforms on Continental Shelf Act, 2002 were also invoked against the marines.
