New Delhi, Dec. 9: The Supreme Court today issued a contempt notice to Sahara Group chief Subrata Roy and two of his employees for allegedly trying to scuttle the ongoing probe in the 2G spectrum scam by intimidating an enforcement directorate official.
A petition was filed by Rajeshwar Singh, assistant director in the enforcement directorate, in this matter.
The apex court felt it had a Constitutional obligation to examine the allegations.
"We are of the view that the petition filed is perfectly maintainable...
"We, therefore, issue a notice to the respondents to show cause why proceedings be not initiated against them for interfering with the court monitored criminal investigation," a bench of justices G.S. Singhvi and K.S. Radhakrishnan said in a judgment.
On February 2, 2012 the apex court had cancelled 122 licences allotted by the telecom ministry in the 2G spectrum allocation in violation of rules, causing an estimated loss of Rs 1.75 lakh crore to the exchequer. Since then it has been monitoring the probe being conducted jointly by the CBI and the enforcement directorate.
The Sahara group had allegedly invested in S-Tel, which is being probed in the 2G scam.
"We may point out that the allegations raised in the contempt petition are of very serious nature and, if proved, would amount to interference with the administration of justice, especially in a court monitored investigation," the apex court said.
"When a court monitors a criminal investigation it is the responsibility and duty of the court to see that the investigation is being carried out in the right direction and the officers entrusted with the task be not intimidated or pressured by any person, however high he may be."
"In a court monitored investigation, if the officer who is entrusted with the investigation is experiencing any threat or pressure from any quarters, he is duty bound to report the same to the court monitoring the investigation.
